Please help me, Allstate won't pay any medical from a car accident?
I don't know who to turn to other then an attorney. My daughter who is in her first year of college got rear ended by a driver at about 25-30 mph. Allstate is calling this a "low speed impact" and trying to apply a program called "MIST" to it. The driver who hit my daughter had his car fully smashed on his front. My daughter needed only a new bumper and bumper brace. This cost $1188. She was taken to ER. Released with rec to follow up. Given pain meds, muscle relaxers, etc.
She missed ten days of school, had to get an MRI and receive chiropractic treatment. She was VERY sore, muscles in neck were swollen to visibility.
Allstate says only soft tissue damages, and basically she should have just sat on her buttt for a month until it got better. Don't we have the right to make sure she was not permanently damaged? How can they not pay this medical? This is crazy! My daughter only asks that her med bills be paid, nothing more. Bills are $8600 total. Why does she have to pay them?
It depends on the state you are in. If you are in a No fault state that has a tort threshold, and your daughter only suffered soft tissue injures - then she would not qualify to pursue an injury claim - as for medical bills - they would be paid by your no fault carrier. If you are not in a no-fault state, but have med pay on your policy, you can pursue the bills under your med pay coverage. Or you can pursue it under your private health.
I'm going to be honest with you, $1188 is not a life altering impact to her vehicle, granted it's not a scratch, but it's not a hard heavy impact - it would be IMPOSSIBLE that a vehicle going 25-30 mph would cause only $1188 to her vehicle. I've been hit at about 30 mph and it caused over $7K to the rear of my car.
As for Allstate not paying the medicals - they may be attempting to compromise due to the "low impact nature of the accident." I highly doubt they are trying to deny the claim correct? As for the medical bills - if your private health did pay them, Allstate would only owe reimbursement for what they paid. Say the bills did total $8600, but your private health only paid $1K and the hospital/medical providers wrote off the remaining $7600, then Allstate would only owe $1K. It's hard to give you more specific advice as we don't know what state your in.
If those bills are outstanding - YES your daughter is the one responsible for them, or if she is a minor, you are responsible - as she is the one who racked up the bills, not Allstate. Allstate is only responsible to reimburse for reasonable and necessary treatment. They may have deemed the treatment unreasonable and unnecessary. If you are unable to come to an agreement with them, you may need to seek outside legal advice to sort out the matter.
